Somatic Experiencing® Training Terms & Conditions - Restoring Resilience

Somatic Experiencing® Professional Training is an educational training program developed by Somatic Experiencing® International ("SEI") and organised in Australia by Restoring Resilience Pty Ltd ("Restoring Resilience", "the Organiser", "we", "us" or "our").

These Terms & Conditions apply to your participation in Somatic Experiencing® Training organised by Restoring Resilience, including associated teaching sessions, demonstrations, experiential exercises, practice sessions, meetings and other training-related activities ("Training").

By submitting an application, accepting a place, paying a deposit or tuition fee, or otherwise confirming your participation, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

1. Training Structure and Participation

Somatic Experiencing® Professional Training is delivered progressively across the Beginner, Intermediate and Advanced stages of the training program.

For the purposes of tuition fees, payments, cancellations and refunds, each of these is considered a separate Training Stage.

Acceptance into the Somatic Experiencing® Training pathway reflects an intention to progress through the program, subject to eligibility, successful completion of prerequisite requirements, availability and any applicable requirements of Somatic Experiencing® International.

Participation in one Training Stage does not create a financial commitment to, or guarantee the tuition fee for, any subsequent Training Stage.

Upon confirmation of your place in the Training pathway, you are agreeing to participate in accordance with these Terms & Conditions and the payment terms applicable to each Training Stage.

Progression to subsequent stages remains subject to applicable prerequisites, training requirements and Somatic Experiencing® International requirements.

2. Tuition Fees

Tuition fees are set separately for each year or Training Stage of the Somatic Experiencing® Training program.

Tuition fees may be reviewed and adjusted between Training Stages to reflect changes in training delivery costs, faculty costs, venue expenses, international licensing or administration costs, exchange rates, regulatory requirements or other relevant circumstances.

Participation in or completion of one Training Stage does not guarantee that the same tuition fee, pricing structure, payment arrangement or discount will apply to a subsequent Training Stage.

The applicable tuition fee for the next Training Stage will be communicated to Participants before payment for that stage is required.

Participants will therefore be advised of the applicable tuition fee and payment terms before becoming financially committed to the next Training Stage.

Agreed Tuition Price

Once a Participant has committed to a particular Training Stage at an agreed tuition fee, Restoring Resilience will honour that agreed tuition fee for that stage, provided the Participant complies with any payment terms, due dates or other conditions attached to that fee.

For example, where a Super Early Bird, Early Bird or other discounted tuition fee is conditional upon full payment being received by a specified date, the discounted price will only apply where those conditions are met.

If the conditions of a discounted fee are not met, the tuition fee applicable at the time payment is subsequently made may apply.

All tuition fees and payments are in Australian dollars (AUD) unless otherwise expressly stated.

3. Deposits and Confirmation of Place

Where a deposit is required, payment of the deposit secures the Participant's place in the applicable Training pathway or Training Stage, as advised by Restoring Resilience.

Unless otherwise stated in writing, deposits are non-refundable for change-of-mind withdrawals, subject always to any rights or remedies available under the Australian Consumer Law.

Payment of a deposit does not secure or guarantee tuition pricing for future Training Stages.

Any deposit paid will be credited toward the tuition fee to which it relates.

A place is not considered confirmed until Restoring Resilience has advised the Participant that their application has been accepted and any required deposit or initial payment has been received.

4. Payment Terms and Payment Plans

Participants are responsible for ensuring all tuition fees are paid in accordance with the payment terms and due dates provided for each Training Stage.

Where Restoring Resilience agrees to a payment plan, the payment plan forms part of the Participant's payment arrangements for that Training Stage.

Unless otherwise agreed in writing, all outstanding tuition fees must be paid by the applicable final payment deadline.

A payment plan does not alter the total tuition fee payable unless Restoring Resilience expressly agrees otherwise in writing.

Failure to make payments when due may result in:

  • loss of eligibility for a discounted tuition rate;
  • suspension of access to training resources;
  • inability to attend the Training until outstanding amounts are resolved; or
  • withdrawal of the Participant's place where reasonable and appropriate.

Restoring Resilience encourages Participants experiencing financial difficulty to contact the Training Coordinator as early as possible so that available options can be discussed.

5. Discounts

From time to time Restoring Resilience may offer Super Early Bird, Early Bird, repeat-student, payment-method or other promotional discounts.

Each discount may have specific eligibility requirements, payment deadlines or other conditions.

A discount is only secured when all conditions attached to that discount have been met.

Unless expressly stated otherwise, a discount offered for one Training Stage does not automatically apply to any subsequent Training Stage.

Where Restoring Resilience offers a discount for a particular payment method, the standard tuition fee and discounted amount will be communicated clearly at the time payment arrangements are provided.

6. Participant-Initiated Withdrawal and Cancellation

If you wish to withdraw from a Training Stage, you must notify Restoring Resilience in writing.

Your eligibility for a refund will be determined in accordance with the Restoring Resilience Refund Policy applicable to your participation and any rights you may have under the Australian Consumer Law.

Non-attendance does not constitute notice of cancellation.

Except where required by law or otherwise approved by Restoring Resilience, no refund or credit will be provided merely because a Participant:

  • does not attend;
  • attends only part of a Training Stage;
  • changes their mind after the applicable cancellation period; or
  • is unable to attend due to personal scheduling or travel arrangements.

Requests involving exceptional circumstances may be considered in accordance with the Refund Policy.

7. Transfers and Deferrals

A Participant does not have an automatic right to transfer their place, tuition fee or deposit to another Training Stage, cohort, location or training date.

Restoring Resilience may, at its discretion, approve a transfer or deferral where circumstances warrant it.

Any approved transfer or deferral must be confirmed in writing and may be subject to:

  • availability in the alternative cohort;
  • applicable SEI training and progression requirements;
  • differences in tuition fees;
  • administrative requirements; and
  • any conditions advised by Restoring Resilience at the time.

Where the tuition fee for the future Training Stage or cohort is higher than the amount previously paid or credited, the Participant may be required to pay the difference.

8. Training Changes, Rescheduling and Cancellation

Restoring Resilience and/or Somatic Experiencing® International may need to change training dates, faculty, schedules, venues, delivery arrangements or other aspects of the Training due to circumstances including, but not limited to:

  • faculty illness or unavailability;
  • insufficient participant numbers;
  • venue changes;
  • travel disruption;
  • public health requirements;
  • natural disasters;
  • government restrictions; or
  • other circumstances reasonably outside the Organiser's control.

Where a material change occurs, Restoring Resilience will notify affected Participants as soon as reasonably practicable.

Where a Training Stage is rescheduled, Participants will be advised of the alternative arrangements and any options available to them.

Where Restoring Resilience cancels a Training Stage and does not provide an appropriate alternative, Participants will be entitled to the remedies set out in the Refund Policy and any additional rights available under Australian Consumer Law.

9. Travel, Accommodation and Personal Expenses

Participants are responsible for arranging and paying for their own travel, accommodation, meals and other personal expenses associated with attending the Training unless expressly stated otherwise.

Participants are encouraged to consider flexible or refundable travel and accommodation arrangements.

To the extent permitted by law, Restoring Resilience is not responsible for travel, accommodation or other personal expenses incurred as a result of a Training change, cancellation or rescheduling that is outside Restoring Resilience's reasonable control.

Nothing in this clause excludes any entitlement to compensation that cannot lawfully be excluded under the Australian Consumer Law.

10. Attendance and Training Requirements

Participants are responsible for understanding and meeting the attendance and progression requirements applicable to Somatic Experiencing® Professional Training.

Completion of a Training Stage, attendance at training modules or payment of tuition fees does not itself guarantee certification as a Somatic Experiencing Practitioner (SEP).

Certification and progression requirements are determined by Somatic Experiencing® International and may include additional requirements such as personal sessions, case consultations, attendance requirements and other professional training obligations.

Participants are responsible for ensuring that they remain eligible to progress through the Training.

11. Professional Responsibility

The Training is provided for educational and professional development purposes.

Participants are responsible for:

  • practising within their professional scope, qualifications and competence;
  • complying with the requirements of their professional registration, association or insurance;
  • obtaining appropriate supervision or consultation where required;
  • determining whether and how material learned during the Training may appropriately be incorporated into their professional practice; and
  • maintaining appropriate professional boundaries and ethical standards.

Participation in the Training does not confer a licence, professional registration or authority to practise outside the Participant's existing professional scope.

12. Participant Wellbeing and Responsibility

Somatic Experiencing® Training includes experiential learning and may involve exploration of physiological sensations, emotions and personal experience.

Participants remain responsible for their own wellbeing and for deciding the extent to which they participate in experiential activities.

Participants are encouraged to communicate with faculty or the training team if they require support, modification or assistance during the Training.

The Training is educational in nature and is not a substitute for individual medical, psychological, psychiatric or therapeutic care.

13. Conduct and Training Environment

Restoring Resilience is committed to providing a respectful, inclusive and professionally appropriate learning environment.

Participants are expected to behave respectfully toward faculty, assistants, staff and other Participants and to comply with any applicable Code of Conduct, training protocols and reasonable directions provided during the Training.

Restoring Resilience reserves the right to address conduct that compromises the safety, wellbeing, integrity or learning environment of the Training.

Where serious or repeated misconduct occurs, Restoring Resilience may require a Participant to leave or withdraw from the Training.

Any refund or other financial outcome in those circumstances will be considered in accordance with the Refund Policy, the circumstances of the matter and applicable law.

14. Confidentiality

The Training relies upon a high degree of trust and confidentiality.

Participants agree to respect the privacy of fellow Participants and not disclose identifying personal information, personal experiences, clinical material or other confidential information shared by another Participant during the Training without that person's express permission.

Any clinical examples discussed during the Training must be appropriately de-identified and handled in accordance with applicable professional, ethical and privacy obligations.

The confidentiality obligation continues after completion of the Training.

15. Privacy

Restoring Resilience collects and uses personal information for purposes associated with administering and delivering the Training, including applications, communications, payments, training records and liaison with Somatic Experiencing® International where required.

Personal information will be handled in accordance with Restoring Resilience's Privacy Policy and applicable Australian privacy laws.

Participants acknowledge that information reasonably necessary for training administration, progression or certification may need to be shared with Somatic Experiencing® International.

16. Audio, Video and Photography

Participants must not make unauthorised audio recordings, video recordings, photographs, screenshots or other recordings of the Training, faculty, assistants or other Participants.

Restoring Resilience may record designated teaching portions of the Training for approved educational purposes.

Experiential practice groups will not ordinarily be recorded unless Participants have been expressly advised otherwise and appropriate consent has been obtained.

Where recordings are made available to a cohort, access is personal to the authorised Participant and must not be copied, downloaded, reproduced, shared, distributed or made available to another person except where Restoring Resilience expressly permits this.

17. Intellectual Property

Training materials, manuals, recordings, presentations, course resources and other educational content may be protected by copyright or other intellectual property rights belonging to Somatic Experiencing® International, faculty members, Restoring Resilience or other rights holders.

Participation in the Training does not transfer ownership of that intellectual property to the Participant.

Training materials are provided for the Participant's personal educational and professional development use only unless expressly stated otherwise.

Participants must not reproduce, publish, distribute, sell, teach from, commercially exploit or otherwise use protected training materials in a manner that infringes the rights of the relevant owner.

18. Promotion and Commercial Activity

Participants must not use the Training environment, participant contact information, online groups or Training communication channels to advertise, solicit or promote their own or a third party's products, services, training programs or commercial activities without prior permission from Restoring Resilience.

This requirement is intended to preserve the integrity and relational safety of the learning environment.

19. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.

Where the Australian Consumer Law provides a Participant with rights or remedies that are inconsistent with a provision of these Terms & Conditions, the Participant's statutory rights prevail.

20. Limitation of Liability

To the maximum extent permitted by law, Restoring Resilience is not responsible for loss or damage arising from matters outside its reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability arising from rights or guarantees that cannot be excluded under the Australian Consumer Law.

Participants remain responsible for their own professional decisions and for how they apply information, principles or techniques learned during the Training.

21. Force Majeure

Restoring Resilience will not be responsible for a delay or inability to deliver the Training caused by circumstances reasonably beyond its control, including natural disasters, severe weather events, fire, flood, epidemic or pandemic, government action, war, civil unrest, industrial disruption, major transportation disruption or faculty incapacity.

Where such circumstances affect the Training, Restoring Resilience will use reasonable efforts to provide alternative arrangements where practicable.

Any refund, transfer or other remedy will be determined having regard to the circumstances, the Refund Policy and applicable law.

22. Changes to These Terms

Restoring Resilience may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to a Participant will be those provided or made available at the time their place in the Training pathway was confirmed, together with any updated terms communicated before a subsequent Training Stage.

Where changes are required by law, regulation, Somatic Experiencing® International requirements or other circumstances affecting delivery of the Training, Restoring Resilience will communicate material changes where reasonably practicable.

A change to these Terms will not retrospectively alter an agreed tuition price for a Training Stage once that price has been confirmed, except where the Participant expressly agrees otherwise or where required by law.

23. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary without affecting the validity of the remaining provisions.

24. Entire Agreement and Written Variations

These Terms & Conditions, together with the Participant's application, applicable tuition fee and payment terms, Refund Policy and any other policies expressly incorporated into participation in the Training, constitute the agreement between the Participant and Restoring Resilience.

Any individual variation agreed between Restoring Resilience and a Participant should be confirmed in writing.

25. Governing Law

These Terms & Conditions are governed by the laws applicable in Victoria, Australia, and the parties submit to the jurisdiction of the courts and tribunals having jurisdiction in Victoria, subject to any rights a Participant may have under applicable consumer law.
