Refund Policy

This Refund Policy applies to Participants in Somatic Experiencing® Professional Training organised by Restoring Resilience Pty Ltd.

Somatic Experiencing® Professional Training is delivered progressively across the Beginner, Intermediate and Advanced Training Stages.

For the purposes of refunds, cancellations, transfers and payment obligations, each Training Stage is considered separately.

Participation in one Training Stage does not create a financial commitment to any subsequent Training Stage.

All requests to withdraw, cancel, transfer or defer must be submitted to Restoring Resilience in writing.

The effective date of withdrawal will generally be the date on which written notice is received by Restoring Resilience.

Non-attendance does not constitute notice of withdrawal or cancellation.

Refunds approved under this policy will ordinarily be returned using the original method of payment unless another method is agreed.

Where a Participant provides written notice of withdrawal more than 30 calendar days before commencement of the applicable Training Stage, tuition fees paid toward that Training Stage will ordinarily be refunded, less any applicable non-refundable deposit.

Where a deposit has been paid to secure the Participant's place, that deposit will ordinarily remain non-refundable for change-of-mind withdrawals, subject to any rights or remedies available under the Australian Consumer Law.

Any refund will be based on the amounts actually paid toward the relevant Training Stage.

Where a deposit is required, payment of the deposit secures the Participant's place in the Training pathway or applicable Training Stage, as advised by Restoring Resilience.

Unless otherwise stated in writing, deposits are non-refundable where a Participant withdraws because of change of mind or personal circumstances.

A deposit relates to the tuition fee for which it was paid and does not secure or guarantee tuition pricing for a future Training Stage.

Where Restoring Resilience approves a transfer or deferral, it may agree to transfer some or all of a deposit to a future cohort or Training Stage.

Nothing in this section limits any right to a refund or other remedy available under the Australian Consumer Law.

Where written notice of withdrawal is received 30 calendar days or less before commencement of the applicable Training Stage, tuition fees will ordinarily be non-refundable.

This reflects the significant commitments made by Restoring Resilience in advance of each Training Stage, including faculty, venue, administration, resources and other delivery costs, together with the reduced ability to replace a Participant close to commencement.

Requests involving exceptional circumstances may be considered under Section 9 of this Refund Policy.

Nothing in this section affects any statutory rights or remedies available under the Australian Consumer Law.

Once a Training Stage has commenced, tuition fees will ordinarily not be refunded where a Participant:

• changes their mind;
• voluntarily withdraws;
• does not attend;
• attends only part of the Training;
• is unable to attend because of personal, professional or travel commitments; or
• does not complete the Training Stage for reasons unrelated to a failure by Restoring Resilience to provide the Training as agreed.

Exceptional circumstances may be considered in accordance with Section 9.

Nothing in this section affects any rights or remedies available under the Australian Consumer Law.

No refund, credit or transfer is automatically available for:

• non-attendance;
• late arrival;
• early departure;
• missing one or more training days;
• partial attendance; or
• failure to complete attendance or progression requirements.

Participants should notify Restoring Resilience as soon as possible if circumstances arise that may prevent attendance.

Where circumstances are exceptional, Restoring Resilience may consider whether an alternative arrangement is reasonably available.

Tuition fees are set separately for each Training Stage.

Participation in one Training Stage does not guarantee the tuition fee, payment arrangement, discount or pricing structure that will apply to a subsequent Training Stage.

The applicable tuition fee for the next Training Stage will be communicated to Participants before payment for that stage is required.

Once a Participant has committed to a particular Training Stage at an agreed tuition fee, that agreed fee will be honoured provided the Participant complies with any applicable payment terms, deadlines or conditions attached to that fee.

Super Early Bird, Early Bird and other discounted tuition fees may be subject to specific payment deadlines and conditions.

Where the conditions attached to a discounted rate are not met, the applicable subsequent tuition rate may become payable.

Any refund will be calculated according to the amount actually paid by the Participant toward the relevant Training Stage.

Restoring Resilience recognises that serious and unforeseen circumstances may arise.

Requests falling outside the standard cancellation timeframes may be considered on a case-by-case basis in circumstances such as:

• serious illness or medical emergency;
• bereavement;
• significant family crisis;
• serious accident or unexpected incapacity; or
• another substantial unforeseen circumstance considered by Restoring Resilience to warrant special consideration.

Supporting documentation may be requested where reasonable.

Depending on the individual circumstances, Restoring Resilience may offer one or more of the following:

• a full or partial refund;
• transfer of some or all amounts paid to a future cohort or Training Stage;
• deferral of participation;
• an alternative payment arrangement; or
• another appropriate resolution.

Consideration under this section is discretionary and does not create an automatic entitlement or precedent for other Participants.

Any statutory rights under the Australian Consumer Law continue to apply independently of this section.

Participants do not have an automatic right to transfer or defer their place, tuition fees or deposit.

Restoring Resilience may approve a transfer or deferral where appropriate.

Any approved arrangement will be confirmed in writing and may be subject to:

• availability in the alternative cohort;
• Somatic Experiencing® International training and progression requirements;
• differences in tuition fees;
• administrative requirements; and
• any other conditions advised at the time.

Where an amount paid is transferred or credited to a future Training Stage or cohort, the credit will ordinarily reflect the amount actually paid.

An approved transfer or deferral does not guarantee the tuition price that applied to the original Training Stage.

If the tuition fee applicable to the future Training Stage or cohort is higher than the transferred credit, the Participant will be responsible for paying the difference unless Restoring Resilience agrees otherwise in writing.

If Restoring Resilience cancels a Training Stage and does not provide an appropriate replacement or alternative arrangement, affected Participants may elect to:

• receive a refund of tuition fees paid toward the cancelled Training Stage; or
• where available and agreed, transfer amounts paid to a future Training Stage or cohort.

No cancellation administration fee will apply where the Training Stage is cancelled by Restoring Resilience.

Any additional rights or remedies available under the Australian Consumer Law continue to apply.

Restoring Resilience may occasionally need to reschedule a Training Stage because of circumstances including faculty illness or unavailability, venue issues, travel disruption, public health requirements, natural disasters, government restrictions or other matters affecting delivery.

Where a Training Stage is rescheduled, Participants will be notified as soon as reasonably practicable and provided with details of the revised arrangements.

Where a material change prevents a Participant from attending the revised dates, Restoring Resilience will consider the circumstances and advise what refund, transfer or other options are available, having regard to the Terms & Conditions and applicable law.

Restoring Resilience may require a Participant to leave or withdraw from the Training where there are significant concerns relating to:

• professional conduct;
• participant safety or wellbeing;
• serious or repeated breaches of applicable policies;
• breaches of confidentiality;
• serious misconduct; or
• conduct that materially disrupts the integrity or learning environment of the Training.

Any refund or financial adjustment in these circumstances will be determined having regard to:

• the reason for withdrawal;
• the proportion of the Training already delivered;
• costs and commitments already incurred;
• the Participant's conduct;
• the individual circumstances; and
• applicable law.

Where withdrawal results from serious misconduct or a serious breach of Training policies, a refund may not be provided except where required by law.

Participants are responsible for arranging and paying for their own travel, accommodation, meals and other personal expenses associated with attending the Training.

Restoring Resilience recommends that Participants consider flexible or refundable travel and accommodation bookings where possible.

To the extent permitted by law, Restoring Resilience does not reimburse travel, accommodation or other personal expenses arising from a Participant's withdrawal or from circumstances outside Restoring Resilience's reasonable control.

Nothing in this section excludes any right to compensation or other remedy that cannot lawfully be excluded under the Australian Consumer Law.

This Refund Policy sets out Restoring Resilience's cancellation and change-of-mind arrangements. It does not replace or limit a Participant's statutory rights.

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Where services supplied by Restoring Resilience fail to meet an applicable consumer guarantee, Participants may be entitled to remedies provided by law depending on the nature and circumstances of the failure.

Nothing in this Refund Policy is intended to exclude, restrict or modify those rights.

Approved refunds will ordinarily be returned using the original payment method where reasonably possible.

Where this is not possible, Restoring Resilience may request appropriate banking details or agree to another refund method.

Restoring Resilience will never request banking passwords, PINs or online banking credentials.

Once a refund has been approved and any necessary payment information has been received, Restoring Resilience will aim to process the refund within 14 business days.

The time taken for funds to appear in a Participant's account after processing may depend on the Participant's bank or payment provider.

Participants will receive written confirmation once the refund has been processed.

Restoring Resilience may update this Refund Policy from time to time.

The Refund Policy applicable to a Participant will be the policy in effect when their place in the Training pathway was confirmed, together with any updated terms communicated before a subsequent Training Stage.

Any amendment will not retrospectively remove an accrued contractual or statutory right.
